TERMS OF USE
As a condition of your participation in any Program or Courses, you acknowledge and agree that you will not:
- share, copy, modify, adapt, translate, decompile, disassemble or reverse engineer the Program or Course content, technology or software (together, the "Course Elements") or otherwise attempt to discover the source code of the software;
- rent, lease or assign the Course Elements to any third party;
- with the exception of any information or materials necessary to fulfill Program or Course requirements or complete Program or Course exercises, download any training tutorials or any other text, multimedia images (graphics, audio and video), data and other information provided in connection with the Course Elements; or
- allow access to the Course Elements by any user other than yourself.
DISCLAIMER OF WARRANTIES
CHA Learning programs, courses and offerings and their related course materials (together, “Content”) are provided "as is" and "as available", without warranty or condition of any kind, either express or implied. CHA Learning expressly disclaims all warranties and conditions, including any statutory or implied warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment or non-infringement in respect to the Content, to the fullest extent permissible under applicable law. While CHA Learning endeavours to provide Content that is correct, accurate and timely, no representations or warranties are made regarding the Content including, without limitation, CHA Learning provides no representation or warranty that (i) the Content will be accurate, reliable, complete, current, timely or suitable for any particular purpose, or (ii) that defects or errors in the Content will be corrected. You acknowledge and agree that you are using the Content, if applicable, at your own risk and liability.
RELEASE OF INDEMNITY
You hereby agree to release CHA Learning and its officers, employees, agents and representatives (together, “Representatives”) from, and in no beginning shall any of them be liable to you or any other person or entity, for any and all liabilities, damages and costs (including any direct, indirect, special, exemplary or consequential damages, including lost profits) whatsoever arising from your use of the Content. You will indemnify and hold harmless CHA Learning and its Representatives from and against any claims, losses, judgments, damages, costs and expenses (including without limitation, reasonable legal fees and expenses) incurred by any of them due to or resulting from your use of the Content. You will also indemnify and hold harmless CHA Learning and its Representatives from and against any claims brought by any third parties arising out of your use of the Content.
